SARASOTA, Fla. -

No longer can you light up in Sarasota parks. City commissioners voted unanimously on Monday to ban tobacco use in all city parks, and will begin looking at specific city owned buildings as well.



The ban comes with a prior recommendation by the city's Parks, Recreation and Environmental Protection Agency and does not include city-owned properties partnered with a private company.

Many people spoke in favor of the ban at Monday's meeting, while others took the podium against the ordinance. Those in favor said they were tired of looking at cigarette butts all over the public parks. Those who spoke against the ordinance felt it was targeting specific park-goers.

Commissioner Shannon Snyder said the ban puts the city in line with other county entities that have banned tobacco use like the Sheriff's Office and all Sarasota County Schools.

"This ordinance does apply to all city parks, not one particular park," Snyder said in response to many commenters who said the ordinance was directed at the homeless at Five Points Park. "If New York can ban smoking in their public parks, I think Sarasota can catch up."

Naples tried to get bill 211 passed to remove the states preemeption law on smoking.It was D.O.A. in comittee! yet the NAZIS are still pushing it!

Sarasota is in clear violation of state law

Smoking already is banned at area beaches, so restrictions at city parks would be a logical extension of those rules.

Smokers go to the beach and parks lite up demand a ticket then sue the city for everything theyve got!

NAPLES ? A discussion about whether to ban smoking on Naples beaches could be heading to the state Legislature.

Naples officials said Wednesday they plan to ask the county?s legislative delegation to work with them to change a state law that says who can regulate smoking.

The law ? dubbed the Florida Clean Indoor Air Act ? has a section that ?preempts regulation of smoking to the state and supersedes any municipal or county ordinance on the subject.?

That preemption is believed to apply to all smoking laws, said City Attorney Bob Pritt, and it would make it easy to toss out a local law if it was contested in court.

There are at least a dozen local governments in Florida that have banned smoking, Pritt said.

Naples Mayor Bill Barnett said he wanted to request the help of the county?s legislative delegation, rather than going forward with a discussion about whether it was feasible to ban smoking on city beaches.

?This is the real deal,? he said. ?We want to change the statute, or at least have the Legislature tweak it. We want home rule. We want to make our own decisions." ...
